Finkelstein comments: Attorneys Michael Chetkof and Allyson Burger (the puppeteers) and Azimoon Baldeo (the puppet) colluded to frame Dr Rudolph Baldeo. They churned out hundreds of pages of official Court papers depicting Dr Baldeo as a sado-psychopath. They calculated that they could steamroll and slander him by exploiting pernicious stereotypes of violent dark-hued immigrant Muslim males. They also figured he was a pushover because he’s slight of stature and a geek.  In the eyes of these greedy vultures, Dr Baldeo was an easy prey: A Little Indian Boy. But they got so carried away in their lies, and they’re so innately stupid and inept, that nearly every statement in their Court papers was contradicted by another statement in these same papers. Unfortunately, there was never a cross-examination: unbearable pressure was exerted on Dr Baldeo to settle the case before he had his day in court.  In this excerpt from my forthcoming article, I enact the cross-examination that never was. The excerpt is meticulously and scrupulously based on the Court record, which I perused in full.  (The forthcoming article will include footnoted references to the quotes cited here.)  This excerpt was presented to Chetkof, Burger and Azimoon Baldeo for comment.  They did not contest any of the facts or interpretations presented herein.  If you are as outraged as I am by this frame-up, you should make your voice heard.

The Cross-Examination of Azimoon Baldeo

You and Dr. Baldeo have been married for 27 years, is that correct?

Azimoon Baldeo: Yes.

In sworn statements submitted to the Court since commencement of divorce proceedings, you have repeatedly alleged that, from the start of your marriage in 1990 until you received an Order of Protection in April 2016, you were subjected on “countless” occasions to “unspeakable violence.” For example, you alleged that Dr. Baldeo has physically abused you “throughout our 26 years marriage”; that you lived “in fear of these countless brutal attacks for the duration of our relationship”; that Dr Baldeo “has spent the past 26 years oscillating between brutally assaulting me and ignoring me completely.” Is that correct?

Azimoon Baldeo: Yes.

Good.  I would want first to get a clear picture clear of what you allegedly endured.  You have repeatedly said that Dr Baldeo is almost never at home, while, on those rare occasions when he is home, he is asleep.  For example, you’ve stated in Court papers that Dr Baldeo’s presence at home has been “sporadic” and “infrequent,” and that he is “hardly ever at the Marital Residence.” You’ve also stated that he left for work at 6:30 pm, returned home at 8:00 am, went to bed, and slept until 5:30 pm. So, on those “sporadic” and “intermittent” occasions that he was at home, he was only awake for an hour.  You also stated that he would “travel at his heart’s content whenever he pleases and return home to terrorize his wife at his pleasure.”

So, for the past 27 years, on those rare occasions when Dr Baldeo wasn’t globe-trotting, and was at home and awake, he was nonstop inflicting “countless” acts of “unspeakable violence” on you?  Basically, you were living with a sadistic monster that brutally beat you every chance he had when he wasn’t away or asleep.  Is that correct?

Azimoon Baldeo: Yes, that’s correct.

Very good.  Can you now tell the Court how Dr Baldeo managed to keep down a steady job if he was only home on an “infrequent” and “sporadic” basis and was “almost never at home,” as he was gallivanting around the world? Was he shuttling back and forth each day from his international vacation spots to the hospital?  

Azimoon Baldeo:  [Silence]

Can you tell the Court how Dr Baldeo managed to violently abuse you “countless” times if he was “almost never at home” and only awake for one hour on those rare days when he was home.  If he was only awake for an hour, he barely had time to shower and shave, isn’t that correct?

Azimoon Baldeo: [Silence]

Okay, now let’s see if we can be a little more precise regarding the time period of these alleged brutal attacks.  You have repeatedly stated in sworn Court testimony that the very first act of alleged physical abuse occurred while you were pregnant with your eldest son, and you were “twenty-one years of age.” For example, you stated that “[t]he first time Defendant became physically abusive” was when he hit you with the telephone and you called the police.  Is that correct?

Azimoon Baldeo: Yes.

In fact, we can pinpoint the exact date of the alleged incident. It occurred on 12 March 1993. It was the day of a blizzard in New York that was called the “Storm of the Century.” Is that correct?

Azimoon Baldeo: Yes.

You also repeatedly stated in sworn Court testimony that the “last” act of physical violence occurred in December 2013 after a birthday party you arranged for Dr Baldeo. You mentioned another incident around Christmas 2014 or 2015—you refer to either year, depending on your testimony—when you were going for brunch with your friends, but you also said that your oldest son intervened before Dr Baldeo could reach you. So, as you repeatedly stated in sworn Court testimony, the “last” alleged act of physical violence occurred in December 2013, is that correct?

Azimoon Baldeo: Yes.

To sum up, the first incident of alleged physical violence occurred in 1993 or three years after you got married, and the last incident occurred in 2013 or three years before you got the Order of Protection.  Is that correct?

Azimoon Baldeo: Yes.

Good.  I’m glad we cleared that up.  So when you stated in a Court submission that Dr Baldeo’s alleged physical abuse started “at the very beginning of our marriage” in 1990, that was incorrect.  According to your own Court papers, didn’t these alleged physical attacks begin fully three years later in 1993?

Azimoon Baldeo: I guess so.

And when you repeatedly stated in Court papers that the alleged violence ended after “the issuance of the April 27, 2016 Temporary Order of Protection,” that was also incorrect. According to your own sworn Court testimony, didn’t these alleged physical attacks end in 2013, or fully three years before the Order of Protection?

Azimoon Baldeo: Yes.

And when you stated in a Court submission that the “frequency” of Dr Baldeo’s alleged “abuse” increased after December 2013, that was presumably also incorrect. According to your own sworn Court testimony, didn’t the “last” alleged incident of physical violence occur in December 2013, so the “frequency” of the abuse couldn’t have increased after December 2013? 

Azimoon Baldeo: [Silence]

Good.  Now that we’ve cleared that up, I’d like to look at the frequency of these alleged physical attacks.  I know you’ve repeatedly alleged that the number of acts of unspeakable violence you’ve endured is “countless.”  But maybe we can be a bit more exact.  Let’s begin with the last 17 years or since the year 2000, where your memory is probably clearest.  On your first day of testimony, you described three incidents of physical violence since the year 2000.  On your second day of testimony, your memory was apparently refreshed by your attorneys and you recalled not three but seven specific incidents since 2000.  If I may, I’d like to list these seven incidents to help you along: 

  • a “hitting” incident while your youngest son was having a seizure
  • a “slapping” incident in the family car
  • a “kicking” incident when Dr Baldeo was preparing pork
  • a “black-and-blue mark” on your arm after Dr Baldeo threw an iPod at you
  • a “pushing” incident in Hawaii
  • a “black eye incident” that your coworkers commented on
  • a “wall hitting” incident on Christmas Day 2013

Is this summary of your testimony correct?

Azimoon Baldeo: I guess so.

You repeated several of these incidents numerous times in your various submissions to the Court and in sworn Court testimony.  Now, I’d like you to think real hard.  Can you recall any other incidents since 2000 that you might have accidentally left out, or that I might have accidentally omitted?

Azimoon Baldeo: No.

So, as far as you can remember, altogether, these “countless” acts of “unspeakable violence” during the past 17 years consisted of a “hitting,” a “slapping,” a “kicking,” a “black-and-blue mark,” a “push,” a “black-eye,” and a “wall hitting.”  It appears, then, that we can count these “countless” acts.  The total comes to seven incidents, or one incident of physical abuse every 900 days, or one incident every two-and-a-half years since the year 2000.  Is that correct? 

Azimoon Baldeo: I guess so.

Good. I would want now to get an overview of these incidents since the year 2000.  You have stated in Court papers that the allegedly “countless” acts of “unspeakable violence” have been “documented.”  For example, you have repeatedly stated that Dr Baldeo “has a long documented history of physically, emotionally and financially abusing me.” Is that correct? 

Azimoon Baldeo: Yes.

I’d like to take a closer look at this “documented history” of the alleged incidents since the year 2000.

Do you have any photographs or other physical evidence of the injuries you sustained from this alleged “unspeakable violence”? 

Azimoon Baldeo: No.

Did you call the police to intercede or to report any of these alleged acts of “unspeakable violence” since the year 2000?  

Azimoon Baldeo: No.

Did any of these alleged acts of “unspeakable violence” require medical attention—did you call an ambulance, did you go to the hospital, are there any medical records attesting to these alleged acts of “unspeakable violence”? 

Azimoon Baldeo: No.

Did you seek any counseling or other professional intervention after these alleged incidents of “unspeakable violence”? 

Azimoon Baldeo: No.

Except for your eldest son—who will not be testifying, your mother-in-law (although she emphatically denies your allegations), and anonymous coworkers, are there any witnesses to these alleged “countless” acts of “unspeakable violence” since the year 2000—for example, your close family members and your close friends? 

Azimoon Baldeo: No.

In fact, according to your Court submissions and sworn Court testimony, your own Mother only once reacted to Dr Baldeo’s alleged “countless” acts of “unspeakable violence”?  When you told your Mother about one alleged instance, you quoted your Mother as replying, “it’s just a minor argument.” Isn’t that correct?

Azimoon Baldeo: Yes.

To sum up, then, in regard to the alleged seven incidents of “unspeakable violence” you suffered the past 17 years, there exists no photographic or other physical evidence, no police records, no medical records, no counseling records, and effectively no witnesses.  In other words, although you’ve alleged in Court papers that Dr Baldeo has a “long documented history” of physically abusing you, there’s not a shred, not a scintilla, of documentary evidence.  Is that correct?

Azimoon Baldeo: [Silence]
